Abstract

The principle of proportionality has emerged as one of the fundamental doctrines governing the application of legal sanctions in modern legal systems. It requires that any legal measure, restriction, or sanction imposed by public authorities correspond appropriately to the gravity of the unlawful conduct and the legitimate objectives pursued. This study examines the role of proportionality in the application of legal sanctions, emphasizing its significance in maintaining fairness, protecting fundamental rights, and strengthening the legitimacy of legal institutions. Using doctrinal legal analysis and comparative perspectives, the research explores the theoretical foundations of proportionality and its practical implementation in administrative, civil, and criminal law. The findings indicate that proportionality serves as an essential safeguard against excessive state intervention and arbitrary punishment while promoting legal certainty and public trust in the justice system. The study concludes that effective application of proportionality contributes to balancing societal interests with individual rights, thereby enhancing the overall effectiveness of legal regulation.
